What Speeeak stores, why, for how long – and what it does not.
In shortEight points on what Speeeak stores – and what it does not. Tap to expand.
- Record without an account. Speeeak asks for neither name nor email address for voice messages. There is a customer account only if you take out a subscription.
- Only the voice message itself is stored – plus what is needed to play it via the link (duration, size, format, time, expiry date, plays).
- Our own servers in the EU (Hetzner). No sharing with third parties, no ad networks, no trackers, no external AI services.
- Automatic deletion depending on the plan: Kostenlos after 7 days, Plus after 90 days, Pro after 90 days, Business after 365 days. You can delete earlier at any time with your delete link.
- Text for your message only on request – speech recognition runs on the same server, without external services.
- Only technically necessary cookies, so no cookie banner.
- Widgets and landing pages of other customers: If you record a message for someone via their Speeeak widget or sign up on their landing page, they are the controller – we process it on their behalf (data processing agreement) and under the same rules. You see beforehand who it goes to and how long it is stored.
- Your data belongs to you: In your account you can export everything as a ZIP at any time and delete your account yourself.

Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. The operator's contact details can be found in the section "Information on the controller" in this Privacy Policy.
How do we collect your data?
On the one hand, your data is collected when you provide it to us. This may, for example, be data that you enter into a contact form.
Other data is collected automatically or with your consent by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time of the page request). This data is collected automatically as soon as you enter this website.
What do we use your data for?
Some of the data is collected in order to ensure that the website is provided without errors. Other data may be used to analyse your user behaviour. Insofar as contracts can be concluded or initiated via the website, the transmitted data is also processed for contract offers, orders or other order enquiries.
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) of the German Telecommunications Digital Services Data Protection Act (TDDDG), insofar as the consent covers the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.
Data processing on behalf
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Storage Period
Unless a more specific storage period has been stated within this Privacy Policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for erasure or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the deletion will take place once these reasons cease to apply.
General Information on the Legal Bases for Data Processing on This Website
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of data pursuant to Art. 9(1) GDPR are processed. In the case of express consent to the transfer of personal data to third countries, data processing is additionally based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information in your terminal device (e.g. via device fingerprinting), the data processing is additionally based on Section 25(1) TDDDG. Consent can be revoked at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data insofar as this is necessary for compliance with a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information on the legal bases applicable in each individual case is provided in the following paragraphs of this Privacy Policy.
Recipients of Personal Data
In the course of our business activities, we work together with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary in the context of the performance of a contract, if we are legally obliged to do so (e.g. transfer of data to tax authorities), if we have a legitimate interest in the transfer pursuant to Art. 6(1)(f) GDPR or if another legal basis permits the transfer of data. When using processors, we only pass on personal data of our customers on the basis of a valid data processing agreement. In the case of joint processing, a joint controllership agreement is concluded.
Revocation of Your Consent to Data Processing
Many data processing operations are only possible with your express consent. You can revoke consent that you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.
Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)
IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).
Right to Lodge a Complaint with the Competent Supervisory Authority
In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.
Right to Data Portability
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
Information, Rectification and Erasure
Within the framework of the applicable statutory provisions, you have the right at any time to receive information free of charge about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to rectification or erasure of this data. You can contact us at any time regarding this and any other questions on the subject of personal data.
Right to Restriction of Processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
- If you contest the accuracy of your personal data stored by us, we will generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was/is unlawful, you may request the restriction of data processing instead of erasure.
- If we no longer need your personal data, but you need it for the exercise, defence or establishment of legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure.
- If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may – apart from its storage – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.
SSL or TLS Encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Encrypted Payment Transactions on This Website
If, after the conclusion of a contract subject to a fee, there is an obligation to transmit your payment data to us (e.g. account number in the case of a direct debit authorisation), this data is required for payment processing.
Payment transactions via the common means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
With encrypted communication, your payment data that you transmit to us cannot be read by third parties.
Objection to Advertising E-mails
We hereby object to the use of contact data published in the context of the legal notice obligation for the purpose of sending unsolicited advertising and information material. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam e-mails.
4. Data Collection on This Website
Cookies
Our websites use so-called "cookies". Cookies are small data packets and do not cause any damage to your terminal device. They are stored on your terminal device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your terminal device until you delete them yourself or they are automatically deleted by your web browser.
Cookies may originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to evaluate user behaviour or for advertising purposes.
Cookies that are required to carry out the electronic communication process, to provide certain functions that you have requested (e.g. for the shopping cart function) or to optimise the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be restricted.
If further cookies and services are used on this website, you can find this out in this Privacy Policy.
Server Log Files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
This data is not merged with other data sources.
This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be collected.
Use of AI on the Website
We use AI-supported services and/or applications on our website.
We use artificial intelligence (AI) on our website as follows:
Speech recognition (conversion of voice messages into text) at the user's request; processing takes place exclusively on our own servers in the EU using a locally operated model, without transmission to third parties and without storage of the audio data beyond the purpose.
When you interact with or come into contact with elements on our website in which artificial intelligence is used (e.g. chatbot), your inputs including metadata are processed in order to generate a suitable answer or response.
The use of these AI-supported functions is based on Art. 6(1)(f) GDPR. We have a legitimate interest in using modern technologies on our website in order to improve our products and services and to identify new potential from the interaction with our customers. If consent is required, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You can revoke your consent at any time.
Further information on the data processing of this tool or service can be found at the relevant point in this Privacy Policy.
Enquiries by E-mail, Telephone or Fax
If you contact us by e-mail, telephone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time.
The data you send to us via contact enquiries remains with us until you request its erasure, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
Registration on This Website
You can register on this website in order to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.
For important changes, for example to the scope of the offer or in the case of technically necessary changes, we use the e-mail address provided during registration to inform you in this way.
The data entered during registration is processed for the purpose of implementing the user relationship established by the registration and, if applicable, for initiating further contracts (Art. 6(1)(b) GDPR).
The data collected during registration is stored by us for as long as you are registered on this website and is subsequently deleted. Statutory retention periods remain unaffected.
Microphone and Recording
When you record a voice message, your browser asks you for permission to use the microphone. The recording is created exclusively on your device and is only transmitted to our server when you select "Create link" or "Convert to text". "Discard recording" and "Record again" do not transmit anything. Uploaded audio files ("Select file") are treated in the same way as recordings.
Voice Messages, Listening Link and Deletion Link
When a listening link is created, we store the audio file as well as its duration, size and format, the time of creation, the expiry date, the number of retrievals, a non-guessable identifier for the listening link and a separate secret for the deletion link. If you reply to a message, we store the link "reply to" so that both messages can be listened to in context. The legal basis is Art. 6(1)(b) GDPR (provision of the service you have requested).
Anyone who knows the listening link can listen to the message. The links are random and cannot be guessed, but they are not protected by a password. Therefore, only share listening links with persons to whom you wish to entrust the message, and keep the deletion link to yourself.
Messages are deleted automatically and permanently after expiry of the period displayed at the time of creation – both the audio file and the data record. With the deletion link, you can trigger the deletion yourself at any time. Each deletion is logged without content (identifier, time, reason) so that we can provide evidence of the deletion. Backup copies of the database do not contain any audio files. Our administration interface only shows identifiers, times, durations and status; it does not play back any messages and does not display any recognised texts.
Text for the Message (Speech Recognition)
Only if you select "Also send as text" when creating the message does a speech recognition model operated by us on the same server convert the recording into text. No external AI providers are used; the recording does not leave our server for this purpose. The recognised text is stored together with the message, displayed to the recipient and deleted together with the message. The "Convert to text" function in the preview works without storage: the recording is processed only for the duration of the conversion, the text appears on your device and is not stored by us. The legal basis is Art. 6(1)(b) GDPR; recognition takes place exclusively at your active request.
Speeeak on Other Websites and Interface (API)
Operators of other websites can use Speeeak via an interface, for example for voice messages or voice input in a chat. In this case, the respective website operator is responsible for the processing; we process the data on their behalf on the basis of a data processing agreement (Art. 28 GDPR) in accordance with the same rules described in this policy. For each access key, we keep a technical log (time, function called, status, duration, IP address of the partner server), which is deleted after 30 days. Content is not stored in this log.
Customer Account and Login
For Speeeak Plus and Business, we set up a customer account. For this purpose, we store your name, e-mail address, a password chosen by you (only as a hash value) and, if desired, a passkey (public key that only works together with your device). To set the password and to log in without a password, we send one-time links by e-mail; they are valid for 48 hours and become invalid after a single use. We store the time of your last login. The legal basis is Art. 6(1)(b) GDPR. The account data remains stored for as long as the account exists (see "Data export and account deletion").
Landing Pages and Sign-up Forms
Customers with Speeeak Plus or Business can publish their voice messages on their own landing page with logo, photo, text and links and offer a sign-up form below. If you sign up on such a page, we store your name (if requested), your e-mail address, the time and the identifier of the message on which you signed up, and display the entry to the customer in their account; at their request, we notify them by e-mail. The respective customer, as operator of the landing page, is the controller for this processing; we process the data on their behalf on the basis of a data processing agreement (Art. 28 GDPR). The entries remain stored until the customer deletes them, deletes the landing page or deletes their account. If you have any questions about your entry, please contact the operator of the landing page; we assist them in fulfilling your rights.
Recorder Widget on Other Websites
Customers can embed a Speeeak recording widget on their own website, through which you can leave them a voice message. The widget is loaded in a frame (iFrame) delivered by us from speeeak.io; the website on which it is embedded has no access to your recording or your inputs. When the widget is loaded, we collect the technical data that is also described under server log files and set a technically necessary session cookie to protect the form against third-party requests (Art. 6(1)(f) GDPR, Section 25(2) no. 2 TDDDG). The recording is created on your device and is only transmitted when you select "Send message". In doing so, we store the audio file, its duration, size and format, the time, the details enabled by the customer (name, e-mail address, subject – insofar as you enter them) and, if the customer has booked text recognition, the recognised text. Before sending, you can see to whom the message is going and how long it will be stored, and confirm this by ticking a box. The message can only be retrieved by the customer in their account and is automatically deleted after the displayed storage period; the customer can delete it beforehand. The customer, as operator of the widget, is the controller; we process the data on their behalf on the basis of a data processing agreement (Art. 28 GDPR). The customer can specify on which websites their widget may be displayed.
Embedding of Voice Messages on Other Websites
Customers can embed a voice message including its landing page in their own website. In doing so, the content is loaded in a frame (iFrame) from speeeak.io; the sections "Server log files", "Voice messages, listening link and deletion link" and "Landing pages and sign-up forms" apply. The embedding website learns from us only the height of the frame, no content and no data about you.
Data Processing Agreement by Click
Customers who have data of third parties processed via landing pages, sign-up forms or the recorder widget conclude a data processing agreement with us in their account pursuant to Art. 28 GDPR. As evidence of the conclusion of the agreement, we store the customer's company name and address, the name of the acting person, the e-mail address of the account, the time, the IP address and the browser identifier at the time of the click, as well as a checksum of the contract text, and we generate from this a PDF that both parties receive. The legal basis is Art. 6(1)(c) GDPR (obligation to provide evidence pursuant to Art. 28(9), Art. 5(2) GDPR) in conjunction with Art. 6(1)(b) GDPR. We retain this evidence for three years beyond the end of the agreement.
Invoices and Contract Data
For each order, we store the billing address, the company name and VAT identification number where applicable, the time of acceptance of the contract terms, the amount, the invoice number and the invoice PDF as well as the status of the payment. Invoices are available for retrieval in the customer account. We retain this data for the duration of the retention periods under commercial and tax law (generally ten years, Section 147 of the German Fiscal Code (AO), Section 257 of the German Commercial Code (HGB)), even after an account has been deleted.
Data Export and Account Deletion
Customers can at any time download all data stored about them in their account as a ZIP file in machine-readable form (Art. 20 GDPR) and delete their account themselves (Art. 17 GDPR). Upon account deletion, all of the customer's voice messages including messages received via widgets, all landing pages including files, entries and widgets are deleted immediately and permanently; each deletion is logged without content. Name, e-mail address, password and passkeys are removed. The account record remains only in anonymised form so that the invoices we are required to retain remain attributable. Ongoing subscriptions end with the account deletion; an existing data processing agreement is terminated, and the evidence of it is retained as described above.
E-mail Dispatch on Behalf of Customers (Own Mail Account)
Customers with a corresponding plan can send e-mails to third parties from within Speeeak (e.g. a voice message as a voice card or a reply to a website visitor). Such e-mails are sent exclusively via the mail account (SMTP) stored by the customer themselves (their mailbox or their e-mail service provider) and under their sender address – not via Speeeak's servers or addresses. We store the access data in encrypted form and use it only for this purpose; the customer can remove it from their account at any time. Recipient addresses are processed only for the delivery of the respective e-mail and are not stored permanently. The respective customer is responsible for the content and lawfulness of these e-mails; the processing takes place within the framework of the data processing agreement.
Help and Documentation (docs.speeeak.io)
This Privacy Policy also applies to our help pages at docs.speeeak.io. These pages are read-only pages: they do not set any cookies, do not store anything in the browser and do not load any content from external servers (no fonts, scripts or images from third parties). The search on the help pages runs entirely in your browser; search terms are not transmitted to us. When a help page is called up, your browser checks with speeeak.io whether an administrative login exists there (only then does an edit button appear); this request does not set any cookies and does not store anything. When the page is called up, only the technical data described under "Server log files" is processed. The buttons "Was this page helpful?" do not store or transmit anything.
Visitor Counting without Tracking
We count the visits to our pages exclusively from the server log files that are generated anyway: per day, the number of page views, of listening pages and of distinct accesses. No cookies are set for this purpose, no profiles are created and no IP addresses are stored beyond the log retention period; only daily totals are retained. The legal basis is Art. 6(1)(f) GDPR (interest in an overview of the use of our service).
No Third-Party Content, No Third Countries
This website does not load any fonts, scripts or content from external servers, does not use any analytics or advertising services and does not transmit any data to countries outside the European Union.
5. eCommerce and Payment Providers
Processing of Customer and Contract Data
We collect, process and use personal customer and contract data for the establishment, content design and amendment of our contractual relationships. We collect, process and use personal data about the use of this website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6(1)(b) GDPR.
The customer data collected is deleted after completion of the order or termination of the business relationship and expiry of any existing statutory retention periods. Statutory retention periods remain unaffected.
Data Transfer upon Conclusion of Contract for Services and Digital Content
We transfer personal data to third parties only if this is necessary in the context of contract processing, for example to the credit institution commissioned with payment processing.
No further transfer of data takes place, or only if you have expressly consented to the transfer. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.
The basis for data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.
Payment Processing via Payrexx
For the processing of payments on speeeak.io, we use the payment platform of Payrexx AG, Burgstrasse 20, 3600 Thun, Switzerland (hereinafter "Payrexx"). Payrexx is a regulated Swiss payment service provider and is certified according to the PCI DSS security standard. We use Payrexx as a white-label solution via our contractual partner oc media GmbH, Hafenweg 19a, 48155 Münster; the technical payment processing and the processing of your payment data are carried out by Payrexx.
Which data is processed. When you take out a Speeeak subscription, the data required for the payment is transmitted to Payrexx or collected directly by Payrexx: name, e-mail address, billing address, payment amount and currency, order or subscription reference, the chosen payment method and the payment data belonging to this payment method (in the case of card payment: card number, expiry date and security code), as well as technical data such as IP address, browser identifier and time of the transaction.
Entry of payment data on our order page. The input fields for payment data are provided as an embedded payment form (iFrame) directly from Payrexx's servers. Your payment data is encrypted and transmitted exclusively to Payrexx or to the respective payment service or card issuer; it is at no time visible to us and is not stored on our systems. When the payment form is loaded, your browser establishes a connection to Payrexx; in doing so, Payrexx may set technically necessary cookies or comparable identifiers that are required for the secure execution of the payment initiated by you and for fraud prevention (Section 25(2) no. 2 TDDDG). From Payrexx we receive only the confirmation or rejection of the payment, a transaction reference, the payment method and, in the case of card payment, the last four digits of the card number.
Subscription and recurring payments. Speeeak subscriptions are billed monthly. So that subsequent payments can be executed without re-entering your payment data, Payrexx stores your payment method in tokenised form: the payment data is replaced by a token that can only be used within the Payrexx platform for debits in favour of Speeeak. Only this token is stored by us, not your payment data. The token is deleted as soon as your subscription has ended and no outstanding claims or refund claims remain, at the latest three months after the end of the contract.
Purposes and legal bases. The processing serves the execution of the payment, the allocation of the payment to your subscription, the execution of the agreed subsequent debits and the refund in the event of a withdrawal or reversal. The legal basis is Art. 6(1)(b) GDPR (performance of the contract concluded with you). Insofar as data is processed to fulfil legal obligations (in particular retention obligations under commercial and tax law), the legal basis is Art. 6(1)(c) GDPR. Processing for the prevention of fraud and misuse is based on Art. 6(1)(f) GDPR; our legitimate interest lies in secure payment processing and protection against payment defaults.
Responsibility. Insofar as Payrexx executes payments as a regulated payment service provider, Payrexx processes your data under its own responsibility in accordance with Payrexx's privacy policy. Insofar as Payrexx provides services on our behalf (in particular the storage of the payment token and the provision of the payment form), this takes place on the basis of the data protection agreements with Payrexx pursuant to Art. 28 GDPR.
Transfer to Switzerland and to third countries. Payrexx is based in Switzerland. An adequacy decision of the European Commission exists for Switzerland (Art. 45 GDPR); the transfer of your data there is therefore permissible without further safeguards. According to its own information, Payrexx processes data primarily in Switzerland and in the European Union, but may involve payment networks, card issuers and service providers outside Switzerland and the European Economic Area for the processing of individual payment methods. Payrexx bases such transfers on the standard data protection clauses of the European Commission or on Art. 49(1)(b) GDPR (necessity for the performance of the contract).
